Booking Terms

The company L.G. Network OÜ operates an online booking platform that allows the visitors to book services offered by local providers and presented on websites dedicated to the covered destinations, which the company also manages.

This booking platform connects visitors with local providers.

While browsing one of the websites dedicated to the covered destinations, the visitors are redirected to the booking platform after having selected a service and carefully considered the options and rates applicable.

These Booking Terms are intended to set out the rules governing any reservation request made by a visitor on the booking platform.

You must read these Booking Terms carefully before using the booking platform.

Definitions:

1. Conditions of access to the booking platform

To access to the booking platform (1.2), first you must accept the Terms and Conditions of Use of the website (1.1).

1.1. Acceptance of the Terms and Conditions of Use of the website

By browsing the booking platform, you agree to comply fully with the rules of use described in the Terms and Conditions of Use of this website, which apply to any visitor.

1.2. Access and availability of the booking platform

Visitors are redirected from the websites dedicated to the covered destinations to the booking platform after having selected a service and carefully considered the options and rates applicable.

Costs of access and navigation on the booking platform are at your own charge exclusively.

The booking platform is provided on an "AS IS" basis and is accessible according to its availability.

WE HAVE NO LIABILITY FOR ANY TRANSMISSION PROBLEMS, FOR ANY FAILURES RELATED TO OUR HOSTING PROVIDER OR FOR ANY NETWORK BREAKDOWNS.

WE CANNOT BE HELD RESPONSIBLE FOR ANY FAILURE TO ACCESS TO THE BOOKING PLATFORM CAUSED BY A MAINTENANCE OR BY THE GRAPHICAL OR TECHNICAL IMPROVEMENTS OF OUR SYSTEMS.

2. Functioning of the booking platform

After presenting the services that can be booked (2.1), this section details the rules applying to the reservation request (2.2), the processing of the request (2.3) and the management of the booking after confirmation (2.4).

2.1. Services that can be booked

2.1.1. Services presented

The booking platform allows you to book services presented on the websites dedicated to the covered destinations and offered by providers (as defined more precisely in Article 3.1).

Visitors are redirected from the websites dedicated to the covered destinations to the booking platform after having selected a service, read the description and carefully considered the options and rates applicable.

On the booking platform, the visitors must carefully read the information about the “included” or “not included” fees as well as a list of “things to keep in mind” during the performance of the service.

The services offered are made available within the limits stipulated in the Terms and Conditions of Use of the website dedicated to the covered destination, available on its home page.

We strive to maintain the exactness, completeness and the updating of the information collected from the providers and mentioned on the booking platform. For this reason, we reserve the right to correct this content at any time and without prior notice.

However, we cannot guarantee the exactness and completeness of this information if it has been altered by a third party without our consent (hacking of our servers, virus, intrusion). FURTHERMORE, WE ASSUME NO LIABILITY FOR ANY INACCURACY, ERROR OR OMISSION IN THE INFORMATION PROVIDED ON THE BOOKING PLATFORM.

2.1.2. Total amount of the service

The total amount of each service corresponds to the sum of the first payment and the remaining amount.

2.2.1. Requirements to request a reservation

2.2.1.1. Legal capacity, validity of personal and additional data, acceptance of the conditions and recommendations, legitimate reservation

The use of our booking platform is restricted to the visitors aged 18 or older and legally capable.

By making a reservation request, you declare and certify that you are aged 18 or older and legally capable of contracting this agreement, use the booking platform and book a service. We have no control over the age indicated in the reservation request nor your legal capacity (that we do not ask) and we cannot be held responsible for that.

You also certify that your personal data and the additional data mentioned in the booking form are true, accurate and complete especially regarding your e-mail address, telephone number and, where applicable, the number of participants and the exact address for pick-up and drop-off.

WE DISCLAIM ANY LIABILITY IN THIS FIELD AND ARE NOT REQUIRED TO VERIFY THE ACCURACY OF YOUR INFORMATION.

You also certify that you have first read, understood and accepted in their entirety the conditions and recommendations indicated in the description of the requested service (age, physical activity index, description) and available on the website dedicated to the covered destination as well as the service’s terms and conditions that are displayed on the booking platform (“included fees”, “not included fees” and a list of “things to keep in mind”).

By making a reservation request for a service with a physical activity index of 2 or 3 out of 3, or when particular physical conditions are needed (being able to swim, climb hundreds of steps…), you certify being healthy enough to execute it safely and without danger.

Furthermore, you attest and certify that you agree to pay to the provider the remaining amount. You understand and agree that the first payment required to confirm your reservation when a provider accepts your request does not represent the total amount of the service you are requesting to book.

Finally, you agree to use the booking platform to make only legitimate reservations on your behalf or on behalf of other persons for whom you are legally authorized to act. Also, you agree not to use the booking platform for purposes that might violate laws and regulations, or be contrary to morality or public order.

IN CASE OF BREACH OF ONE OR MORE OF THESE COMMITMENTS, L.G. NETWORK RESERVES THE RIGHT, WITHOUT NOTICE OR OBLIGATION OF ANY KIND, TO DENY YOU ACCESS TO THE WEBSITE BY BLOCKING YOUR IP ADDRESSES AND TO CANCEL YOUR RESERVATION (CF ARTICLE 2.4.3.2.2). IN THIS CASE, THE FIRST PAYMENT IS NOT REFUNDED. WE RESERVE ALSO THE RIGHT TO TAKE LEGAL ACTION AGAINST YOU IF PERMITTED BY LAW.

2.2.1.2. Foreign entry requirements, health and safety

When you make a reservation request by using the booking platform, you are responsible for making sure that you meet all the foreign entry requirements and that your travel documents, passport and visas included where applicable, are in order. You should also inquire about recommendations issued by the authorities of your country of residence or those of the country of destination to the attention of travellers, related to health and safety.

This information is provided on the website dedicated to the covered destination within the limits stipulated in its Terms and Conditions of Use, available on its home page by clicking on the link called “Terms of Use”.

Because foreign entry, health requirements and recommendations related to the safety may change at any time, you are responsible – both before booking a service and before departure – for checking with competent authorities and your doctor the information made available on the website dedicated to the covered destination and to make appropriate use of those information.

FINALLY, ALTHOUGH WE ALLOW THE RESERVATION OF SERVICES FOR SEVERAL DESTINATIONS, WE DO NOT CERTIFY OR GUARANTEE THAT TRAVELLING TO THESE DESTINATIONS IS WITHOUT RISK. WE ARE NOT LIABLE FOR ANY DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVELLING TO SUCH DESTINATIONS.

2.2.1.3. Transportation to a railway station, a port, an airport, a hotel or any place

When a reservation concerns transportation services to a train station, port, airport, hotel or any other place, you shall decide on your own the departure time at which the driver will pick you up. Therefore, you are entirely responsible for taking into account a large enough margin in order to make sure you’ll be on time, even in case of a traffic jam, for checking-in, boarding (for a plane, boat, bus or train) or arriving within the check-in timeframe of your accommodation, or to any other place.

WE DO NOT ASSUME ANY LIABILITY FOR ANY DAMAGES OR LOSSES OR EXPENSES, DIRECT OR INDIRECT, RESULTING OF A LATE ARRIVAL AT THE DESIRED PLACE OF DESTINATION.

2.2.1.4. Travel insurance

WE DO NOT PROVIDE ANY TRAVEL INSURANCE WITH THE SERVICES.

Therefore, when you make a reservation request by using the booking platform, you must first ensure that you have a comprehensive travel insurance (or subscribe to it) in order to be covered in case of accident in the destination country and, if possible, to cover cancellation fees and expenses associated with a modification or cancellation of your trip if an unexpected event occurs.

You must read carefully and in their entirety the general and special conditions of your travel insurance in order to take note of the conditions under which you are covered and those in which you are not.

2.2.2. Process to follow

To make a reservation request for a service, you must complete its dedicated form on the booking platform by indicating the number of participants, selecting a date and options (if needed) as well as entering your personal data and unconditionally accept these Booking Terms. Please note that sending a reservation request is free of charge.

Once the form is completed and validated, an email is sent instantly to the email address indicated in your reservation request. This email certifies that your request has been sent.

At this time, your reservation is not yet confirmed.

2.3. Processing of the reservation request

2.3.1. Verification of providers’ availability

Once your reservation request has been sent through our booking platform, we contact the relevant providers to check their availability.

A response is sent to you by email at the address indicated in the booking form over the next 36 hours after the time at which your reservation request has been saved.

When the service is offered by several providers and that the one you selected is unavailable, your reservation request is then transferred to other providers.

2.3.2. Settlement of the first payment if the reservation request is accepted

If your request is accepted, you must proceed to the first payment to confirm your reservation. Without this payment, your reservation remains not confirmed.

You must proceed to the first payment by using online and secure means of payment with a debit or credit card issued by a compatible payment organization (Visa, MasterCard, etc.) whose name is mentioned on the booking platform.

You shall proceed to the first payment as promptly as possible to avoid being unable to confirm your reservation if another visitor confirms a similar request in the meantime. A request is considered similar when it belongs to the same provider and for the same date.

Any reservation request not already confirmed with the first payment less than 72 hours after reservation time is automatically expired. Proceeding to the first payment is therefore impossible and the request is closed.

Proceeding to the first payment may also be denied when the service starts in less than 12 hours because of a late booking. This minimum 12-hour period is intended to make sure the provider has sufficient time to prepare the service under normal conditions.

Once the first payment has been received, a confirmation email is sent to the address indicated in the booking form. This email resumes information about your reservation, including the amount of the first payment received, the remaining amount due on site, the terms and conditions related to the service (“included” and “not included” fees) and a list of “useful things to keep in mind”. Only the provider’s contact details are not communicated in this email and are then included in the reminders sent a few days before the performance of the service (pursuant to Article 2.4.1). This is intended for providing you with updated information.

2.4. Management of a booking after confirmation

After receiving confirmation of your reservation, you will then thereafter receive the coordinates of the provider (2.4.1). In some cases, the reservation can be modified (2.4.2) or cancelled (2.4.3).

2.4.1. Delivery of contact details

2.4.1.1 Delivery of provider’s contact details to the visitor

Provider’s contact details (phone number, address if you need to go to a meeting place on your own) will be sent to you by email to the email address specified in the booking form 5 days before the day chosen for the service and / or 2 days before if your reservation was made tardily.

2.4.1.2. Delivery of visitor’s contact details to the provider

Visitor’s contact details (name, first name, country, phone number and email address) will be sent to the provider by email 5 days before the day chosen for the service and / or 2 days before if your reservation was made tardily.

2.4.2. Modification of a reservation

The modification of a booking may be initiated by the travellers, the provider or by L.G. Network.

2.4.2.1. Modification by the travellers

If after receiving the confirmation of your request, you wish to change the date chosen for the service, you must contact us by responding to the email confirming your booking and indicate the new desired date. If the provider is already busy on that date, you can keep the original date or cancel your reservation under the conditions of Article 2.4.3.1.

If you want to make another modification than the date, you must contact us by responding to the email confirming your booking and indicate the desired modification. We will study your request with the provider.

If this modification increases the price of the booking, settlement of a complement for the first payment may then be claimed. If the new price doesn’t suit you, you can keep the original booking or cancel your reservation under the conditions of Article 2.4.3.1.

If this modification decreases the price of the booking, no partial refund of the first payment may be claimed.

Please note: the modification request is not possible within 72 hours before the beginning of the service.

2.4.2.2. Modification initiated by L.G. Network or by the provider

2.4.2.2.1. Inability of the provider

If after confirming your request, the provider responsible for carrying out the requested service is unable to perform the service he has agreed, we may transfer the execution of this service to another provider in the original terms, instead of cancelling your booking. In such a case, you will receive an email confirming the modification with the name of the new provider.

If this change suits you, the service will be performed by the new provider.

If this modification does not suit you and that your opposition is legitimate (e.g. the first provider was able to speak French but the new one is not), you must let us know as soon as possible. We will then cancel your request in the conditions of Case 1 of article 2.4.3.2.1.

2.4.2.2.2. Hazardous weather conditions

For services being performed mainly outdoor (hiking, excursion aboard a boat), the provider may contact you to reschedule the service depending on his availability if the weather conditions are making the booked service hazardous.

If you are available on the requested day, the service will be rescheduled.

If you are not available on that day, you must contact us. We will then cancel your reservation in the conditions of Case 2 of article 2.4.3.2.1.

2.4.3. Cancellation of a reservation

Due to their nature (leisure activities on a specific date), services are not subject to the 14-days withdrawal period - which generally benefits to the consumer in the case of distance selling contracts - in accordance with Directive No. 2011 / 83 / EU of the European Parliament and of the Council of 25 October 2011 on consumer rights.

Cancellations are however possible, as detailed hereinafter.

They can be made by travellers or by L.G. Network.

2.4.3.1. Cancellation of a reservation by the travellers

You can cancel your reservation at any time. To do so, you must follow the method set out in the last email received concerning your reservation at the email address specified during your reservation request.

To proceed, you must click on the cancellation link and fill out the cancellation form. Depending on the time remaining before the starting time of the service, you may also be asked to contact the local provider directly by phone (the phone number will be indicated in the email) to avoid any waste of time for him.

As a result of your cancellation, the remaining amount that shall be paid to the provider won’t be due anymore. However, the first payment will not be refunded as it is refundable only if the cancellation comes from the provider or L.G. Network.

2.4.3.2. Cancellation of a reservation by L.G. Network

In some cases, we may be constrained to cancel a confirmed booking.

This cancellation may result from an inability to maintain the service or non-compliance with a commitment of the Article 2.2.1.1 of these Booking Terms.

2.4.3.2.1. Cancellation of a reservation in case of inability to maintain the service

This can be observed in the following cases:

In the first two cases, you would be notified as soon as possible by email to the email address specified in the booking form or by phone using the phone number specified in the booking form. Following this cancellation, the remaining amount that must be paid to the provider won’t be due anymore and the first payment will be refunded within a maximum period of 14 days following the cancellation.

In this third case, we will do our best to keep you informed concerning the cancellation of your reservation and according to the means of communication at our disposal. Following this cancellation, the remaining amount that must be paid to the provider will not be due anymore. As the problem originated from an external event beyond our control, the first payment will however not be refunded.

2.4.3.2.2. Non-compliance with a commitment of the Article 2.2.1.1 of these Booking Terms

In case of non-compliance with one or more commitments stipulated in Article 2.2.1.1 of these Booking Terms which prevent from performing the requested service in the agreed terms, L.G. Network reserves the right to cancel your booking without notice or obligation of any kind whatsoever. Following this cancellation, the remaining amount that must be paid to the provider will not be due anymore. As the problem originated from the traveller’s mistake, the first payment will however not be refunded.

3. Performing the booked service

This section specifies that the services are performed by the providers (3.1). Thus, consequences about our liability will be described thereafter (3.2). Finally, once a service has been performed, you will be asked to leave a review about our booking platform (3.3).

3.1. Performing of the service by the local provider & Payment of the remaining amount by the traveller

The services are performed by local providers. You understand that the providers listed on the websites dedicated to the covered destinations, whose services can be booked through our booking platform, are independent contractors: they are neither employees nor agents of L.G. Network.

By making a reservation through our booking platform, you enter into a direct contractual relationship with the local provider concerned by your reservation. We act solely as an intermediary between you and the provider, by transmitting the details of your reservation to the provider and by sending you a confirmation email and reminders for and on behalf of the provider.

This implies that the provider is solely responsible for the proper execution of the service and will seek to resolve disputes directly with you if necessary.

The consequences of the above regarding our liability are set out in the Article 3.2.

In return for the performing of the service, you shall pay the remaining amount to the provider that is carrying out the service at the end of it by following the terms of payment stipulated in the Article 2.1.3.

3.2. Liability

YOU MUST CAREFULLY READ THIS SECTION WHICH LIMITS L.G. NETWORK’S LIABILITY TO YOUR ENCOUNTER CONCERNING THE PROBLEMS THAT MAY ARISE WHEN USING OUR BOOKING PLATFORM.

The liability of L.G. Network is limited to the provision of the booking platform.

As soon as you start a new reservation, we act solely as an intermediary between you and the provider, by transmitting the details of your reservation to the provider and by sending you a confirmation email and reminders for and on behalf of the provider. L.G. Network is not a contracting party to the contract between you and the provider(s).

WE ARE NOT LIABLE IF THE CONTRACTUALLY AGREED PROCESSING TIMES ARE EXCEEDED WHEN A STRIKE, FORCE MAJEURE OR ANY OTHER EVENT BEYOND OUR CONTROL OCCURS.

THE PARTICIPATION TO A SERVICE OFFERED ON ONE OF THE WEBSITES DEDICATED TO THE COVERED DESTINATIONS AND BOOKED BY USING THE BOOKING PLATFORM IS SOLELY AT YOUR OWN RISK.

L.G. Network is not a travel agency. We do not provide or own transportation services, excursions or accommodations.

You understand that the listed providers are not our employees nor our agents. They are independent contractors. Thus, although we have personally met the providers, tested their services and decided to list them for their experience, their seriousness and their reliability and to facilitate booking a service with them, the use of their services is at your own risk. The fact that their services are listed on our booking platform and on the websites dedicated to the covered destinations does not constitute sponsorship or approval of these providers.

You are solely responsible for all the arrangements you will take with the providers, particularly concerning program changes, times and places of meeting.

You also understand that we cannot control the calendar of the providers nor the quality of services or anything else related to the services performed by the providers. We do not investigate about their background and we don’t provide any warranty about the providers and their services.

In addition, some providers promise to allocate a part of the funds collected for a service to a non-governmental organization or a particular cause. We do not check the truthfulness of such donations and assume no liability related to this matter.

WE ASSUME NO LIABILITY FOR ANY ACTS, ERRORS, FAILURES, OMISSIONS OR NEGLIGENCE OF THE PROVIDERS, AND FOR ANY PERSONAL INJURIES, INCLUDING DEATH, MATERIAL DAMAGE OR OTHER DAMAGES, LOSSES OR EXPENSES OF ANY KIND ARISING FROM YOUR CONTACT WITH THE PROVIDERS, INCLUDING IN CASE OF PARTIAL PERFORMANCE OF A SERVICE, CANCELLATION OR REPROGRAMMING OF A SERVICE.

L.G. NETWORK WILL NOT REFUND THE FIRST PAYMENT PREVIOUSLY PAID AND SHALL NOT BE LIABLE FOR ADDITIONAL EXPENSES RELATED TO A DELAY, CANCELLATION, PARTIAL OR TOTAL NON-PERFORMANCE OF A SERVICE CAUSED BY A STRIKE, AN ACT OF ANY ADMINISTRATION, A VOLCANIC ERUPTION, AN EARTHQUAKE OR A TSUNAMI, FORCE MAJEURE OR ANY OTHER EVENT BEYOND OUR CONTROL.

In any case, if our liability came to be engaged towards you, it would be limited to the amount of the first payment previously paid for your reservation.

3.3. Review system

Our booking platform also allows travellers to leave reviews (feedback) about services they have experienced.

By leaving a review on our booking platform, you agree that this review may be published on the booking platform and on the website dedicated to the covered destination. You also agree that it may be translated into another language than yours.

In addition, you agree not to write a review which:

L.G. NETWORK IS NOT LIABLE FOR THE REVIEWS PUBLISHED BY VISITORS AND FOR LOSSES AND DAMAGES LINKED TO THESE REVIEWS.

We reserve the right, at our sole discretion and without notice, to remove, filter or edit any review with the aim of removing inappropriate comments. Also, if you want to keep a backup copy of your review, you must do so. You are solely responsible for this creation and this is at your own charge.

4. Links to third party websites & virus

Hypertext links set up, where appropriate, in the booking platform towards other websites do not engage our responsibility, whether in terms of accessibility or content. Thus, we may not be held liable for any damage whatsoever, direct or indirect, resulting from the use made of the content of websites to which we refer.

You are responsible for taking the necessary precautions to ensure that our booking platform or one of the websites accessed by a hypertext link does not contain any virus or destructive parasite. Under no circumstances, may we be held liable for any direct or indirect damages arising from the use of our booking platform or any other website to which we refer.

5. Privacy and Cookies

By using the booking platform, we may collect some personal data and one or more ’cookies’ may be stored on your device, under the conditions described in the Privacy & Cookies Policy.

6. Governing Law and Jurisdiction

When you book a service, the Booking Terms constitute, with the Cancellation Policy, the Terms and Conditions of Use of this website and its Privacy & Cookies Policy, as well as the Terms and Conditions of Use of the website dedicated to the covered destination and its Privacy & Cookies Policy, the entire agreement between you and L.G. Network.

They supersede all prior or contemporaneous communications and proposals, whether electronic or oral, between you and L.G. Network.

They shall be governed by the law of Estonia.

You agree that only the courts in Estonia are competent, exclusively, to interpret the terms of these Booking Terms and to settle disputes of any kind arising from the use of our booking platform.

The original version of these Booking Terms was written in French and has then been translated in English. Thus, in case of dispute about the content or interpretation of these Booking Terms or in the event of inconsistency or difference between the French version and the English version, the French version to the extent permitted by law prevails and shall be conclusive. The French version is available on this website (by choosing the French language).

If any provision of these Booking Terms is held to be invalid or unenforceable by an Estonian competent jurisdiction, the invalidity of that provision shall not affect the validity of the other provisions of these Booking Terms, which will remain in full effect and enforceable.

Any rights not expressly granted in these Booking Terms are reserved by L.G. Network.
